Law and an Ethical Principle

Law and an Ethical Principle

Law and an Ethical Principle

Review the Council for Exceptional Children Ethical Principles. What is the difference between a law and an ethical principle? Provide examples of where a special education law and CEC ethical principle overlap, and discuss why it is important to follow both. Do you see any contradictions between these laws and principles? Support your position.

Law is “the system of rules that a particular country or community recognizes as regulating the actions of its members and may enforce by the imposition of penalties” (Marriam-Webster, 2018).

Ethical Principle is “Ethical principles provide a generalized framework within which particular ethical dilemmas may be analyzed” (School of Education, 2018). What follows are definitions of five ethical principles that have been applied within a number of professions (Beauchamp & Childress, 1979):

  1. Respecting autonomy
  2. Doing no harm (nonmaleficence)
  3. Benefiting others (beneficence)
  4. Being just (justice)
  5. Being faithful (fidelity)

An example of where a special education law and CEC ethical principles overlap is in the Special Education Professional Ethical Principle number 2: maintaining a high level of professional competence and integrity and exercising professional judgement to benefit individuals with exceptionalities and their families (Council for Exceptional Children, 2018). It is important to follow both because not only is it the law, but it is also ethical to be maintain high level of professional competence. These ethics and law has a very important and effective role in being a great teacher.

Another example, is during including all students in meaningful and inclusive participation of individuals with exceptions that I see is that CEC principles. This not only is law it is also ethical to include everyone no matter of race, color, learning style, shape or size!
